These General Terms and Conditions (GTC) regulate the rights and obligations relating to the use of the services offered on the website www.kapels.com

OBJECT OF AGREEMENT

By placing an order, the customer confirms that she/he has read and accepted the General Terms and Conditions of KAPEL’S. KAPEL’S is entitled at any time to amend its GTC without notifying the customer or publication on the website of < kapels.com > ("Website").

CONCLUSION

The contractual relationship with KAPEL’S is concluded with confirmation of the order in the shopping cart of the website and payment.

PRODUCTS

Minor deviations from the products shown in colour, structure and workmanship are expressly reserved.

All prices are quoted in Swiss francs (CHF).

KAPEL’S is entitled to adjust the prices without prior notice on the website. The price at the time of the order applies.

KAPEL’S deliver in all the European countries. For orders / deliveries outside Switzerland and the Principality of Liechtenstein, the customer is responsible for the due payment of value added tax / VAT on the import of the goods into the country of import designated by him.

PAYMENT

Payment is due immediately upon order. Payment can be made by Mastercard, Visa, American Express or PayPal.

Credit card

KAPEL’S accepts Visa, Mastercard and American Express credit cards. The customer is automatically forwarded for payment after sending the order. The order is forwarded to a stripe interface, where the customer enters his credit card information. A connection to the card issuer is then established. The customer's credit card account will be debited upon completion of the order.

PayPal

To pay with PayPal's online payment service, the customer needs to register with PayPal. The customer's bank or credit card details are only stored with PayPal and the customer pays with just two clicks, as the stored data is automatically accessed.

DELIVERY

All deliveries within Switzerland and Europe are sent by Swiss Post.

As far as possible, the entire order will be delivered in one delivery. KAPEL’S reserves the right to ship the order in partial deliveries.

Local import taxes or duties on the parcel or delays due to border processes are the sole responsibility of the customer, and in no part and under no circumstances are they the responsibility of KAPEL’S.

Under no circumstances shall delays in delivery give rise to claims for damages on the part of the customer.

OWNERSHIP

The delivered goods remain the property of KAPEL’S until full payment.

RETURNS AND COMPLAINTS

Return

KAPEL’S attaches great importance to the fact that its customers are satisfied with their purchase.

The return must be received by KAPEL’S within 14 calendar days from the date of delivery. If the customer does not notify KAPEL’S about the return in advance and/or the 14-day return period has passed, KAPEL’S will be unable to offer a refund or exchange.

All items must be returned unworn, in an undamaged condition in their original undamaged with their security tag and all labels attached, as well as a printed copy of the invoice.

The customer is responsible for paying return shipping costs. KAPEL’S does not refund shipping costs. If the customer receives a refund, the cost of shipping his order will be deducted from his refund.

For International returns, the customer is liable for all import fees on entry to Switzerland. Failure to do so will likely incur import charges for which the customer remains liable and which will be deducted from his refunded balance upon receipt.

KAPEL’S is in no way responsible for the loss of items that the customer dispatches for return.

Complaints

The goods must be checked for completeness, integrity and correctness immediately after acceptance. If the customer discovers defects during this inspection of the goods, the customer is obliged to send at least one photo and a description of the defect to info@kapels.com within 3 days. After expiry of this period, KAPEL’S does not assume any warranty services for defects that should have been detected during an inspection after acceptance of the goods.

Handmade products are unique in their shape and materialization. Complaints regarding deviations in size, shape, colour and materialisation do not constitute a substitute right.

Guarantees

There is no warranty claim for normal wear and tear, improper use and treatment or damage by the customer or third parties as well as defects due to external influences such as force majeure, etc.

Any warranty claim also expires in the event of further processing or modification of the product by the customer.

KAPEL’S has the right to provide the warranty service freely at its discretion by replacement as new or by free repair.

Further claims of the customer, in particular for direct and indirect damages, are expressly excluded.

If a delivery is incomplete, KAPEL’S is entitled to deliver the missing parts later.

Return

The return costs shall be borne by the customer.

The return must be received by KAPEL’S within 14 calendar days from the date of delivery or no refund or exchange will be offered.

All items must be returned unworn, in an undamaged condition in their original undamaged packaging with their security tag and all labels attached, as well as a printed copy of the invoice.

The customer is responsible for paying return shipping costs, otherwise it will be deducted from his refund. KAPEL’S does not refund shipping costs.

Credit note purchase amount

The payment made will be refunded within a few days after receipt and inspection of the returned goods by KAPEL’S.

For credit card payments, the customer will be refunded the amount to his credit card account. The chargeback will be credited with the credit card statement. KAPEL’S has no influence on the billing date of the respective credit card statement.

Payment by PayPal will be credited to the PayPal account.

DISCLAIMER

KAPEL’S excludes any liability (including negligence) that may arise from access to or impossible access to the online shop or individual elements and from use. Access to and use of the Online Shop is not guaranteed.

As the operator of the website, KAPEL’S is responsible for its own content in accordance with Swiss legislation. The content of the pages is created with the greatest care, but some information may change in the meantime. KAPEL’S assumes no liability whatsoever with regard to the correctness, accuracy, timeliness, reliability and completeness of the information.

References and links to third-party websites are carefully checked at the time of linking, but these are outside the area of responsibility of KAPEL’S. Any liability claims against KAPEL’S due to material or immaterial damage resulting from access to or use or non-use of the published information, misuse of the connection or technical faults are excluded in full.

All offers are non-binding. KAPEL’S expressly reserves the right to change, supplement or delete parts of the pages or the entire offer without separate announcement or to cease publication temporarily or permanently.

All contents (logo, design, text, images, photos, graphics, structure and the like) on the website are protected by copyright and belong to KAPEL’S. Duplication, processing, distribution and any kind of exploitation require the prior written consent of KAPEL’S.

PRIVACY

The protection of the privacy of customers is a matter of high priority for KAPEL’S. The following explains the principles according to which personal data (information that determines or makes personal identity determinable) collect and process via this website and its applications.

This Privacy Policy collects both historical and future personal data. The offer of the website of KAPEL’S is subject to Swiss data protection legislation. Unless otherwise agreed with the customer, the customer data arising during order processing will only be used to ensure business transactions.

The owner of the corresponding data collection is KAPEL’S.

General – Use of Information

Customers' personal data will not be sold or shared with third parties. Exceptions to this principle of KAPEL’S are (i) external service providers who process the absolutely necessary data on behalf of KAPEL’S for the provision of the services of KAPEL’S and for the processing of transactions; (ii) Customer or User consents to such transfer of Data; or (iii) KAPEL’S or its auxiliary persons are legally obliged to transfer the data.

In cooperation with its hosting provider, KAPEL’S strives to protect the data as well as possible against unauthorized access, loss, misuse or falsification.

In principle, the website can be visited without the user having to provide any personal information. The user's personal data is only collected if this is done voluntarily, for example in the context of an inquiry or registration. This data is used in each case for contract processing or the processing of inquiries.

Newsletter

After registering for the newsletter, the e-mail address can be used for KAPEL’S own advertising purposes until the customer unsubscribes from the newsletter. There is a right to unsubscribe from the newsletter at any time.

Online store based on Wix

The online shop of KAPEL’S is hosted by Wix.com Ltd. The company Wix.com provides KAPEL’S with the online e-commerce platform, which allows KAPEL’S to offer its products online. User and customer data is stored on protected Wix.com servers.

On the website of KAPEL’S, cookies are used to make the visit more attractive and to enable the use of certain functions. These are small text files that are stored on the computer or mobile device. Most of the cookies used are deleted from the user's hard drive at the end of the browser session (so-called session cookies).
